Welcome to CityScroller ("CityScroller", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the CityScroller website, mobile applications, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using CityScroller, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

2. Status of the Service Provider

CityScroller is currently operated on an unincorporated basis. The Service may later be transferred to or operated by a legal entity incorporated in Romania or another jurisdiction. Continued use of the Service after such transition constitutes acceptance of the updated provider information.

3. Accounts

Certain features of the Service require you to create an account.

You agree to:

  • Provide accurate, complete, and current information
  • Maintain the security of your login credentials
  • Accept full responsibility for all activity that occurs under your account

You are solely responsible for any actions taken through your account.

4. Use of the Service

CityScroller provides tools and features for discovering, exploring, and navigating cities, including map-based and location-aware functionality.

You agree to use the Service only for lawful purposes and not to:

  • Violate any applicable law or regulation
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt unauthorized access to systems or data
  • Reverse engineer, scrape, or misuse the Service
  • Use the Service for commercial purposes without our prior consent

5. Location-Based Features

The Service may rely on location data to provide maps, navigation, recommendations, and nearby content.

By enabling location services, you consent to the collection and use of location data in accordance with our Privacy Policy. You may disable location access through your device settings, but doing so may limit functionality.

6. User-Generated Content

The Service may now or in the future allow you to create, upload, submit, or publish content, including text, images, or other materials ("User Content").

6.1 Responsibility

You are solely and fully legally responsible for all User Content you create, upload, or share through the Service.

You represent and warrant that:

  • You own or have all necessary rights to your User Content
  • Your User Content does not violate any law, regulation, or third-party rights
  • Your User Content is not unlawful, misleading, abusive, defamatory, or otherwise harmful

6.2 License

You retain ownership of your User Content. However, by submitting it, you grant CityScroller a non-exclusive, worldwide, royalty-free, sublicensable license to use, host, store, display, reproduce, and modify such content solely for operating, improving, and promoting the Service.

6.3 Moderation

We reserve the right, but not the obligation, to remove, restrict, or review User Content at our discretion and without notice.

7. Intellectual Property

All content, software, designs, trademarks, and technology provided by CityScroller, excluding User Content, are owned by or licensed to CityScroller and protected by intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works without prior written permission.

8. Privacy and Data Protection

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, store, and protect personal data.

We aim to comply with applicable data protection laws, including but not limited to:

  • The General Data Protection Regulation (GDPR)
  • UK GDPR
  • Applicable U.S. privacy laws

9. Service Availability and Changes

The Service is provided on an "as is" and "as available" basis.

We may:

  • Modify, suspend, or discontinue any part of the Service

We do not guarantee uninterrupted or error-free operation.

10. Termination

You may stop using the Service at any time.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CITYSCROLLER DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CITYSCROLLER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify and hold harmless CityScroller from any claims, damages, liabilities, losses, or expenses arising out of:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms or applicable law

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania, without regard to conflict of law principles.

Where required by applicable law, consumers may have the right to bring claims in their local courts.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will make reasonable efforts to notify users. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
